1. Acceptance
By accessing or using creativedna.co.ug (the “Site”) or engaging with creativeDNA (U) LTD (“creativeDNA,” “we,” “us”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.
Separate written agreements may govern specific client projects, software licences, or service contracts. Where those agreements conflict with these Terms regarding a specific project, the written agreement prevails.
2. Our services
creativeDNA provides technology solutions including software development, mobile applications, design, cloud hosting guidance, and related consulting services. Information on the Site is for general description only and does not constitute a binding offer until confirmed in a separate agreement.
3. Acceptable use
You agree not to:
- Use the Site in any unlawful manner or for fraudulent purposes
- Attempt to gain unauthorised access to our systems or networks
- Interfere with or disrupt the Site or its security features
- Scrape, harvest, or automate access to the Site without our prior written consent
- Upload or transmit malware, spam, or harmful code
- Misrepresent your affiliation with creativeDNA
4. Intellectual property
All content on the Site — including text, graphics, logos, images, and software — is owned by creativeDNA or its licensors and protected by intellectual property laws. You may view and download content for personal, non-commercial use only. Any other use requires our prior written permission.
Client-owned deliverables and project IP are governed by applicable client agreements.
5. Third-party links and apps
The Site may link to third-party websites or app stores (including Google Play for NTV GO). We are not responsible for third-party content, policies, or practices. Your use of mobile applications such as NTV GO is subject to the NTV GO Privacy Policy, applicable app store terms, and any end-user licence associated with the app.
6. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, creativeDNA AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE RELEVANT SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
8. Indemnity
You agree to indemnify and hold harmless creativeDNA from claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Site.
9. Termination
We may suspend or terminate access to the Site at any time, with or without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties.
10. Governing law and disputes
These Terms are governed by the laws of the Republic of Uganda, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Uganda, unless otherwise agreed in writing.
11. Changes
We may modify these Terms at any time by posting an updated version on this page. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms where permitted by law.
